New DUI Laws in South Carolina

A tougher DUI bill that supporters say would save lives recently passed in the South Carolina Senate. The bill requires drivers convicted of a first-offense DUI with a blood alcohol level of .12 or above to install ignition interlocks on their cars.

The bill passed by a vote of 41-0 just after 6 o’clock Wednesday evening.

The state currently requires the interlocks for drivers upon a second or subsequent DUI. A driver is considered legally drunk with a blood alcohol level of .08, so this bill is targeting what are called “high-BAC” drivers.

Ignition interlocks are small devices installed on cars and they require the driver to blow into them before starting the car. If the device detects alcohol of .02 or more, the car won’t start.

The interlocks that would be used include a camera, to make sure that the person who is blowing into the device is the driver who’s required to have it.

This bill would strengthen the penalties for not installing the interlocks.  Now, a first offense has a fine of $300, jail from 10 to 30 days, or both. Under the bill, a first offense for not having an interlock would be a fine of at least $500, 90 days in jail or six months home detention, and an extension of six months for requiring an ignition interlock.

But it’s the repeat offenders who would really be hit hard. Now, a third or subsequent offense for not having a required interlock is a $1,000 fine and jail up to 90 days, or home detention from 90 days to six months.

Under the bill, a third or subsequent offense would be a felony, with a fine of at least $5,000, prison up to 10 years or home detention for three years, and extending the required use of an ignition interlock by three years.

The offenders would have to pay to install the devices on their vehicles. Ignition interlock manufacturers say they cost about $100 a month, but there’s an additional charge of $30 a month, which will provide interlocks for those drivers who can prove they can’t afford them, despite being able to afford a car, gas and SR-22 insurance.

DVLA proposes rise in driving licence fees

The DVLA has proposed a rise in driving licence fees, starting April 2013. This comes in answer to their rising costs- costs which can only be fully covered by implementing these increased customer fees.

Clearly set out are three possible options: Application of the £20 common driver fee to provisional licences; implementation of 5-yearly renewal applications for vocational driving licences; increase in fee for a first provisional car or motorcycle licence to £52.25 and increase of common driver fee to £20.70.

Mark Is My Hero

I have gone through a terrible nightmare trying to keep up insurance for my daughter who had a dui (due to  prescribed new meds for her bipolar disease)  and I have to tell you how much Mark C. (Serenity Insurance) has done for us.

Drunk Driving Classifications by State

While “DUI” is the most common classification for drunk driving, not every state uses DUI or driving under the influence when it comes to drunk driving convictions and arrests.

The following states use the term DUI: Alabama, Arizona, California, Colorado, Connecticut, Delaware, Washington DC, Florida, Georgia, Idaho, Illinois, Kansas, Kentucky, Maryland, Michigan, Mississippi, Montana, Nebraska, Nevada, New Hampshire, North Dakota, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Utah, Vermont, Virginia, Washington, West Virginia and Wyoming.

Still, DUI is not the only classification for drunk driving in these states.  For example, in Colorado or New York you may also be arrested and charged with DWAI, which stands for driving while ability impaired. DWAI is a lesser charge than DUI, meaning that your blood alcohol concentration was between .05% and .079% at the time of the arrest. The sanctions against one’s driving privilege are also less for a DWAI charge.

Not as many states recognize the term DWI, which stands for driving while intoxicated. There are also certain states like Minnesota or New Mexico that only use the term DWI for drunk driving convictions. The states that use DWI are: Arkansas, Louisiana, Minnesota, Missouri, New Jersey, New Mexico, New York, North Carolina and Texas.

OUI or operating under the influence is a term used in the states of Maine and Rhode Island. OVI or operating a vehicle while impaired is a term used in Ohio. OWI or operating while intoxicated is a term used in Indiana, Iowa and Wisconsin.

There are also certain states that will use the term “OMVI” or operating a motor vehicle intoxicated. “OUID” or operating under the influence of drugs is used in some states. “OUIL” or operating under the influence of liquor is also used in a few states.

So as you can see just because someone is considered DUI in one state, does not necessarily mean that a person arrested for drunk driving in another state is necessarily facing a DUI charge.

New proposals for more driving penalties

If new government proposals are to go ahead, then driving penalties could get a lot more severe very soon. Offences such as speeding are to have their penalties increased by up to 50%, so instead of three points and a £60 fine, those breaking the limit could be looking at double that amount. It isn’t only speeding that is destined to be treated more severely, as using a hand-held mobile phone or not fastening your seat belt could also see you in severe driving hot water.

If fines were to go ahead, then the government could stand to gain an extra £33.5 milion a year in driving penalties alone, but they haven’t stopped there. They are planning to introduce fines for other offences, such as tailgating and cutting up other drivers, which would incur an on the spot £90 and three points on your licence.

California DUI Reportability Requirements FAQs

Q1.    What changes affect DUI offenses on a driving record?

A.   Effective January 1, 2007, new legislation extends the reporting period for DUI offenses from 7 to 10 years for all public requestors, including insurance companies.

Q2.    Why did the law change?

A.  The new law allows insurance companies access to the driving record information to properly apply the new provisions of the Insurance Code established under Senate Bill 597 (2005), to determine a customer’s eligibility for a good driver discount. Based on the new laws, drivers with a DUI violation occurring within the past 10 years are not entitled to receive a good driver discount.

Q3.    I had a DUI in June 2003 that no longer appears on my driving record. Will this violation now show on my record again, since it occurred less than 10 years ago?

A.  Yes, based on the law, your DUI offense will appear on your driving record and will remain there until June 2013, 10 years from the violation date.

Q4.    I have been getting a “good driver” discount on my car insurance ever since my 2004 DUI went off my record in 2011. Will I still qualify for this discount?

A.  Unfortunately, no. Under the CA law, you may not qualify for a good driver discount again until 2014, 10 years from the date of your DUI violation. You may want to contact your insurance representative if you have additional questions regarding your insurance premiums.

Q5.    Will my DUI violation automatically be removed from my driving record after 10 years?

A.  Yes, a DUI offense that occurred more than 10 years ago will not appear on your out-of-house/public driving record.

Q6.    Will the law affect me if my DUI violation occurred over 10 years ago?

A.  No, a DUI violation that is already more than 10 years old will not reappear on your driving record.

Q7.    How do I know which violations will report for 10 years?

A.  Under the new law, any DUI violation under California Vehicle Code sections 23140, 23152, or 23153 will report for 10 years. There are some other non-DUI violations (e.g. 23103.5 “wet” reckless) that will report to courts and law enforcement for 10 years and may count against you for the purpose of determining increased penalties for repeat offenders, but will continue to show on a public driving record for only 7 years.

Q8.    Why is the DMV discriminating against individuals with DUI offenses?

A.  The department is not discriminating against individuals with DUI offenses. It is implementing legislation that is intended to discourage DUIs by increasing the time-period that an offense remains on an individual’s driving record.

Q9.     Will an exception to the new law be made if an individual has no tickets or violations after the DUI offense?

A.  No, the 10-year reporting period applies to all non-commercial drivers, even those who maintain a clean driving record thereafter.

Q10.     What will happen if my insurance company previously gave me a good driver discount and now finds out I had a DUI more than 7 years ago.

A.  It will be up to your insurance company to correctly apply the provisions of the Insurance Code and make decisions regarding your policy based on specific entries on your driving record. They may modify your existing policy, offer you a new policy that does not include a good driver discount, or cancel your policy completely.

Check with your insurance company representative if you have specific questions related to your eligibility for a good driver discount.

Q11.    I drive for a living and my employer participates in the DMV Employer Pull Notice (EPN) Program. My employer is not aware that I had a DUI in December 1997. Will my DUI now be reported to my employer?

A.  Effective January 1, 2007, your DUI will again report on your driving record since it occurred within the past 10 years.  The department’s EPN program automatically generates and mails a driver record to the employer for newly enrolled drivers, or upon any action or activity updated to the record, or annually for currently enrolled drivers.

Although employers will not automatically be notified of a DUI that reappears on a driving record when the new law takes effect on January 1, 2007, the DUI violation will appear on the next printout DMV provides to your employer.

Q12.    I drive for my employer.  I’m afraid I will lose my job if my employer finds out I had a DUI in 1998.  The DUI did not appear on my DMV printout that I provided to my employer nine months ago when I was first hired.

A.  It will be up to your employer to determine if the DUI will affect your employment. You may want to discuss your concerns with your employer.

Q13.    How does the new law affect me if I have a commercial driver license (CDL)?

A.  The new law pertains only to non-commercial drivers.  Due to federal requirements established under the Motor Carrier Safety Improvement Act of 1999 (MCSIA), the reporting period for DUI violations is different for commercial drivers.

For example, a conviction for a major violation committed in a commercial vehicle (e.g. DUI) will be retained for a period of 55 years on a CDL record, as will a driver license suspension or any withdrawal action.

Q14.     What will happen if my insurance policy is cancelled because of a DUI violation?

A.  If your insurance policy is cancelled for any reason, you need to get new insurance right away, since it is illegal to own or operate a vehicle without liability insurance in California. Current law requires your insurance company to electronically report your insurance information to DMV. The best and worst PIN numbers

Do you have one of the most predictable PIN numbers in the world? If so, your cash could be at risk.

I’m going to try to guess your PIN number… is it 1234? According to new research, there is a pretty good chance I’m right. If I were a criminal who had stolen your card, I could be emptying your account right now.

Shockingly, research by technology consultancy Data Genetics has found that almost 11% of the population chooses this number – with 1111 and 0000 being the second and third most popular options.

Not surprisingly, fraudsters have a pretty easy time cracking such predictable codes and the data reveals that it is possible to guess 10% of PINs in just one attempt.

In contrast, the random (and far less memorable) collection of numbers 8068 is the least common PIN – though there’s a pretty good chance that will change now this research has been published.

In order to conduct the research, Data Genetics looked at the details of 3.4 million four-digit passwords that have been leaked via security breaches.

Although these codes are computer passwords, the study assumes that most people will use a similar set of numbers for their PINs.

Here are the 10 most common choices according to the data:

How we choose our PIN

Many people appear to opt for significant dates such as birthdays and anniversaries as codes beginning with the numbers 19 feature highly in the list.

Fans of George Orwell don’t appear overly concerned that Big Brother will guess their PIN – 1984 is the 26th most common choice. Likewise, fans of James Bond could possibly be using their PIN as a way to pay homage to their hero as 0007 is the 23rd most popular choice.

Keeping your PIN safe

Fortunately there are a number of things you can do to keep your PIN safe.

Avoid the obvious:

As well as the codes mentioned on the list above, stay clear of having your date of birth, your children’s birthdays or a wedding anniversary.

In fact, try to keep it random – even the most scatterbrained individual can probably remember four numbers.

Keep it secret

Although you might be tempted to share your PIN with friends or family, this could leave you thousands of pounds out of pocket. If you were the victim of fraud and your bank discovered you had shared your PIN details, it might refuse to refund your money.

Take care at the cash machine

In order to steal PIN details, fraudsters place hidden devices and cameras in ATMs. Although these can be almost impossible to detect, it’s wise to avoid any cash point that appears to have been damaged or vandalised.

Remember, a bank will never ask for details of your PIN number over the phone. If someone calls claiming to be from your bank and asks for this information, you’re probably speaking to a fraudster.

The Most Significant European Cars Bound for the U.S. Market at the Paris Auto Show

While auto shows are constantly happening almost year-round an all around the world, there are a few that truly stand out, such as the Paris Auto Show, which runs from Sept. 29 – Oct. 14. As is the case with most significant car shows oversees, most of the models featured are, unfortunately, not for sale in the U.S. However, this year’s show offers a significant number of cars that could have huge potential for their respective manufacturers here in the states. Here are four such models making their auto show debuts in Paris:

BMW Concept Active Tourer

No, your eyes aren’t deceiving you. The image you see at the top of this post is in fact a BMW. The Concept Active Tourer will provide competition for Mercedes-Benz’s B-Class EV in the upscale, but efficient and utilitarian market. Both cars are aimed at buyers looking for a small, eco-friendly car that can comfortably fit four adults, all while providing more luxurious appointments than typical hybrids and EVs. Shockingly, the car also breaks with BMW tradition of powering the rear wheels by instead sending power from the car’s diminutive 1.5 liter 3-cylinder engine to the front wheels, while a synchronous electric motor powers the rear wheels. The electric motor can run without assistance from the internal combustion engine for almost 20 miles before its lithium-ion battery depletes. The battery can be recharged with a standard household 220-volt outlet.

Jaguar F-Type

The Jaguar F-Type marks a significant milestone for the British marquee brand. The all-new F-Type will be the first true convertible sports car the company has offered in, well, ages. The car is aimed at splitting the upscale, small sports convertible/coupe market between cars like the BMW Z4 and Porsche Boxter, and more expensive models like the Porsche 911 and Aston Martin Vantage. The all-aluminum chassis will come strictly as a two-seater, and will be available with a 3.0-liter supercharged V6 that pumps out 380 hp and 339 lb-ft. of torque, or a 5.0-liter V8 with a staggering output of 495 hp and 460 lb-ft. of torque. Surprisingly, the vehicle will only be offered with a ZF eight speed automatic transmission (with paddles at least). However, Autoblog.com suspects that a six-speed manual will be offered by the next model year, possibly on an even hotter R model.

2013 Range Rover

Despite the tight economic conditions still looming in the U.S., those who have the income to fork over big bucks for massive, luxo-SUVs continue to do so. For this reason, Land Rover’s new Ranger Rover needs to maintain its success on this side of the Atlantic. The previous model, which debuted in 2002, was a smash hit, and judging from the tweaked, yet familiar styling cues of the upcoming 2013 model, Land Rover doesn’t want to mess with success. While the 2013 model may look like only a sleeker version of the model it replaces from its profile, a substantially redesigned front head draws styling cues from the company’s radical Evoque, as well as a completely restyled interior. Like most manufacturers, even Land Rover is focused on improving efficiency, as the new chassis loses 700 lbs. thanks to an all-aluminum unibody structure.

2013 Volkswagen Golf

While it may not be as intriguing as the more expensive, luxurious, and sporty offerings mentioned above, the new Golf is certainly the most significant in terms of potential sales figures. The small, sporty-yet-practical hatch has been a hit for 20-something-year-old buyers in the states for decades, and VW needs a strong sales performance from the car in the U.S. to keep up with the company’s goals of being the world’s largest manufacturer, as well as the best in a tough economic climate. The new Golf features a complete redesign and an all-new platform that uses lightweight, high-strength steel. The new steel structure makes the car 220 lbs. lighter than the model it replaces, while growing a half-inch in width, and 2.3 inches in length. Expect the U.S. version to phase out the aging 2.5-liter five cylinder engine in favor of a new 1.8-liter turbo-four as well, along with a turbodiesel variant.
